The Colorado man who went to Pakistan earlier this year intending to kill Osama bin Laden has been arrested by the Colorado State Patrol on charges of third-degree assault and domestic violence in Clear Creek County.
The arrest was made around 4 p.m. Tuesday after a vehicle crashed on North Spring Gulch Road in Clear Creek County, according to State Trooper Heather Cobler.
Cobler said that a blue Ford Explorer ran off the right side of the road.
The driver, Jennifer Logie-Oliver, 51, was suspected of driving under the influence of alcohol, said Cobler.
In examining Logie-Oliver, troopers determined that her injuries were inconsistent with the crash, said Cobler.
The troopers did additional investigation and subsequently arrested the passenger in the vehicle, 51-year-old Gary Faulkner, for investigation of third-degree assault and involvement in domestic violence, said Cobler.
Both were taken to the Clear Creek County Jail, where they were booked.
In a warrantless arrest affidavit, the troopers investigating said both Faulkner and Logie-Oliver denied that any physical violence had occurred between them.
However, troopers said they were told by Clear Creek EMS ambulance service personnel that when they arrived they found an on-going domestic dispute and Logie-Oliver "heavily intoxicated."
Troopers observed four "very fresh bruises" on Logie-Oliver's head. She first claimed she got them from hitting her head in the accident. She then said she got them when she fell down a hill where she and Faulkner had taken a walk, according to the affidavit.
Both said they had been drinking while out on the walk.
Faulkner told investigators he was upset with the way Logie-Oliver was driving and was "in a heated argument with her," according to the affidavit.
Troopers said Logie-Oliver, who refused to perform roadside maneuvers or submit to chemical testing, pleaded with officers not to arrest Faulkner.
Faulkner was detained in the mountains of Pakistan in mid-June after Pakistani authorities found him carrying a pistol, a 40-inch sword, a dagger and night-vision goggles.
He reportedly was attempting to cross the border from the Chitral region into the nearby Afghan province of Nuristan because he had heard bin Laden was living there.
Faulkner returned to the Denver area several weeks after his detention in Pakistan.
Scott Turner, the assistant district attorney for the 5th Judicial District in Clear Creek, said Faulkner has a first advisement today, where he will be told he is being held for investigation of third-degree assault and domestic violence.
Because Faulkner is on kidney dialysis, he will then be transferred to the Jefferson County Jail so he can receive proper medical treatment, said Turner.
Turner said third-degree assault is a misdemeanor and sentence enhancer for domestic violence, which he said is an undefined offense. A decision on whether a case will be filed will be up to the 5th Judicial district attorney's office.
